New Federal Rule on Non-Domiciled CDLs: What Drivers Need to Know

FMCSA issued an emergency interim final non-domiciled CDL rule that tightens who can get or renew a non-domiciled CDL/CLP. Texas DPS has already stopped issuing or renewing CDLs for refugees, asylees, and DACA recipients. Other states will follow as they align with the federal rule.

What changed in non-domiciled CDL rule:

FMCSA now requires non-citizen CDL/CLP applicants (not including green-card holders) to meet stricter proof and process at every issuance, renewal, transfer, or upgrade:

  • Must show an unexpired foreign passport and unexpired I-94 tied to specific employment-based visas (H-2A, H-2B, E-2).
  • States must verify status through DHS SAVE.
  • In-person renewals only (no mail renewals).
  • CDL expiration is limited to the I-94 date or one year, whichever is sooner.
  • States must downgrade licenses if the holder becomes ineligible.

Why FMCSA Changed the Rule:

To stop situations where someone keeps a valid CDL long after their legal right to work (or be in the U.S.) has ended, Take a look at this example:
A driver in California was issued a CDL valid until 2030, even though his work authorization expired in 2022. Under the new rule, this won’t be possible.

Under the new federal rule:

  • A CDL cannot be issued for longer than the I-94 “admit until” date (or one year, whichever is shorter).
  • An EAD alone is no longer enough. The driver would need a valid passport + I-94 tied to an H-2A, H-2B, or E-2 visa.
  • This kind of mismatch (license valid years past immigration status) is now prohibited. States must downgrade or deny if the immigration status expires.

Who can still qualify:

  • U.S. citizens and lawful permanent residents (green cards): unaffected.
  • Non-citizens with H-2A, H-2B, or E-2 visas: eligible if passport + I-94 are current. Renewals will be shorter (tied to I-94 or one year).

Who is blocked:

  • Refugees, asylees, and DACA recipients are already excluded in Texas; more states will adopt the same.
  • EAD-only holders (work permit without qualifying visa) do not meet the rule’s requirements.


What drivers should expect at renewal:

Bring this every time:

  1. Unexpired foreign passport
  2. Unexpired I-94 showing H-2A, H-2B, or E-2
  3. Be ready for SAVE verification
  4. In-person visit to DPS/DMV
  5. CDL expiration tied to I-94 or one year (shorter window)

Impact on the industry:

Non-domiciled CDL rule will tighten the driver market. FMCSA estimates more than 190,000 non-domiciled CDL holders could lose eligibility as renewals come due, while only a small number of H-2B/H-2A drivers will still qualify. That means:

  • Driver pool shrinks significantly.
  • Renewal cycles shorten, creating more paperwork and administrative load.
  • Rates may spike in some lanes as supply tightens.
  • Experienced drivers without the specified visas will be forced out, even if safe and qualified.

In short, the rule aims at security and compliance, but it also cuts off a large part of the workforce, leaving carriers and shippers to absorb the shortage.
